Medical liens in injury cases: keeping them organized

Before a settlement can be paid out, every lien and reimbursement claim has to be known, confirmed and resolved. A simple tracker keeps them from becoming a last-minute scramble.

In most injury cases, someone other than the client has a claim on part of the recovery: a health insurer, a government program, a hospital or a provider who treated on a letter of protection. Counsel decides which claims are valid and how to resolve them. Litigation support keeps the list complete and current.

Common sources of claims

  • Health insurance: the plan may seek reimbursement for what it paid.
  • Medicare and Medicaid: government programs have their own reimbursement processes and timelines.
  • Hospital liens: some local rules allow hospitals to record liens for treatment.
  • Letters of protection: providers who treated on the promise of payment from the recovery.
  • Workers' compensation: when the injury happened at work.

What to track for each one

  • Who holds the claim and how to reach them.
  • The type of claim and the date it was first asserted.
  • The amount claimed, with the itemization behind it.
  • Every request, dispute and reduction, with dates.
  • The final agreed amount and proof it was paid.

Start early

Request lien information at intake and update it as treatment continues. Final amounts often take weeks to confirm, and waiting until settlement delays the client's money.

Our medical lien tracker keeps every claim, its amount and its status in one list.

Litigation support is performed at the direction of a licensed attorney. Which liens apply, and how they are resolved, is counsel's decision.
